Obituary for Honorable Luke K Burns Jr


The Honorable Luke K. Burns, Jr., 79, of Westminster, Maryland, died on November 3, 2013, at Carroll Hospital Center following a brief illness.

Judge Burns was born on January 27, 1934, in Baltimore, Maryland. He was the son of the late Luke Kenny Burns, Sr. and Mary Jane Reed Burns. He was predeceased by wife Sally Burns in 1989. He is survived by his wife, Marcia Burns, whom he married in 1999.

He attended Loyola Blakefield High School in Baltimore. He was educated by the Jesuit order, studying Greek and Latin, and received his B.A. from Fordham University in New York in 1957. He received his LL.B. from University of Baltimore School of Law in 1964. He was admitted to practice law in Maryland in 1964 and was a member of the Maryland and Carroll County Bar Associations.

He began the private practice of law in Baltimore. In 1972, he moved to Carroll County and entered practice with Stanford Hoff and Charles Stoner. He remained in private practice until 1978, when he was appointed by the Governor as Associate Judge of the District Court of Maryland for Carroll County. On September 28, 1979, he was again appointed by the Governor, then to the Circuit Court of Maryland for Carroll County. Judge Burns successfully stood for election twice, and he served as Judge until his retirement on January 23, 2004. From the date of his retirement until his death, Judge Burns continued to preside over cases in the Circuit Court for Howard and Carroll Counties as a visiting Judge.

Judge Burns presided over thousands of cases during his distinguished career. He was a kind, compassionate, and thoughtful jurist. Attorneys both in the local community and across the entire state held Judge Burns in high regard. He was as a mentor for countless attorneys and took pride in their development as seasoned lawyers.

As a jurist, his greatest joy was presiding over adoptions. After adoption regulations changed in 1984, Judge Burns offered to take over the handling of adoptions from the other judges. On the day of his retirement, one of the final matters on his docket was an adoption. “It's the best thing I do,” he said. “I will miss doing adoption cases.”

Judge Burns loved books and was an avid reader. He was also a passionate sports fan, beginning in his youth when he would travel by train by himself to Philadelphia to see the Philadelphia A's play, and throughout his entire life, following high school, college and professional teams. In later years he enjoyed playing golf and vacationing in Florida.

Surviving in addition to his wife are son and daughter-in-law, Robert M. and Jennifer Burns of Nashville, TN.; daughter and son-in-law Nancy and Michael Reilly of Philadelphia, PA; grandchildren Kathleen Blair and Sarah Margaret Burns, Jean Adelaide, Michael Luke, Peter John, Robert William, Mark Augustine and Sally Elizabeth Reilly; step children and spouses Parker and Vicki Leimbach of Westminster and Ashley and Matthew Baker of New Oxford, PA; and step grandchildren Justus Kirk, Austin Jenkins and Jacob David Leimbach, Coy Jenkins and Cade Whitman Baker; sister-in-law Lucy Horn Burns. He is also survived by many nieces, nephews, and cousins in the Maryland area.

He was predeceased by brothers John Reed Burns, Sr. and Joseph Patrick Burns.

The family will receive friends on Thursday, November 7, from 2 to 4 and 6 to 8 p.m. at Pritts Funeral Home and Chapel, 412 Washington Rd., Westminster.

A Mass of Christian burial will be held on Friday, November 8, at 11:00 a.m. at St. John's Catholic Church, 43 Monroe St., Westminster. Interment will be in Westminster Cemetery with a reception to follow.

In lieu of flowers, memorial contributions should be made in his name to Carroll Hospital Center-Cardiac and Stroke Program, 200 Memorial Ave., Westminster, Md. 21157

Carroll faces fine for stormwater fee implementation

Carroll County is facing fines of up to $10,000 a day after the Maryland Department of Environment and the Attorney General's Office reviewed the county's efforts to avoid levying a stormwater fee on residents.

The Board of Carroll County Commissioners voted unanimously June 27 to adopt a resolution creating a Watershed Protection and Restoration Fund to be funded by grants and county dollars instead of creating a stormwater fee paid by area businesses and residents.

The state's Watershed Protection and Restoration Program, signed into law in 2012, requires the state's nine largest counties and Baltimore City to collect fees to pay for stormwater management as well as stream and wetland restoration projects. The projects are aimed at improving water quality and reducing phosphorous and nitrogen entering the Chesapeake Bay.

TOWSON, MD (November 1, 2013)-The groundbreaking Public Safety Works inmate restorative justice initiative celebrates another milestone on November 5, when The Departments of Public Safety and Correctional Services (DPSCS), Housing and Community Development (DHCD), Labor, Licensing and Regulation (DLLR), and Disabilities (DOD) join the City of Westminster to cut the ribbon celebrating more than 200 ADA-compliant curbs that were done by inmates in downtown Westminster.

Grant-funded thanks to work by the Maryland Department of Housing and Community Development, the curb project is the largest project of its kind ever done by inmates in the DPSCS Public Safety Works community project initiative. The inmates learned concrete skills from Romano Concrete, a longtime and valued partner with DPSCS.

DPSCS Secretary Gary Maynard, Westminster Mayor Kevin Utz, and top leaders from DHCD and Access Maryland will all be on hand, as will some of the inmates who worked on the project.

The annual Halloween parade in Historic Downtown Westminster on October 29th. Registration begins at 6pm on Monroe St. near Dutterer's Park. The parade begins at 7pm via Pennsylvania Avenue to Main Street and ending on Longwell Avenue. This event is coordinated by the American Legion Post #31. Call 410-857-7953 for more information.

In November, The Artists’ Gallery presents the work of Phyllis Jacobs and the members of the Artists Gallery.

Risk-taking in art is usually associated with young artists.  Phyllis Jacobs doubts the truth of this. She asks, “How might an artist approaching the latter years of life remain productive?”  There seem to be two choices: continue refining what has been the signature work of nearly 50 years, or take the risk of a challenge in totally new terrains. Acrylic canvases of the past, some large enough cover a wall, give way now to small paperworks mounted on cradled birch panels. The sense of touch remains. Paintings made on an iPad respond to fingers on the screen. Pencil drawings enhanced with gauze, coffee filters, bold erasures, and spilled liquids may be selected as much for how they feel in the hand as they do to the eye.

Patricia Gail “PMS” Smith, age 57, of Keymar, Maryland died on Thursday, October 24, 2013 at Carroll Hospital Center in Westminster following a battle with cancer.

Born November 13, 1955 in Taneytown, Maryland, she was the daughter of Carolyn (Hamp) Morningstar of Westminster and the late Kenneth Morningstar.

She is survived by her husband of 29 years, John E. Smith, Sr.

Pat graduated from Francis Scott Key High School in 1973.  She worked as a nurse at Carroll Hospital Center for many years, and was currently a surgical coordinator for Chesapeake Urology.  She loved spending time with her grandchildren and family.

Surviving in addition to her husband are daughter, Dawn Middaugh and husband Dustin of Taneytown; son, Johnny E. Smith, Jr. and wife Amy of Taneytown; grandchildren, Coby and Callie Middaugh, and Delaney Smith; siblings, Katherine Greene of New Windsor, Helen Hawk, Kenneth Morningstar, and Joseph Morningstar all of Taneytown, Susan Morrison of FL, William Morningstar of Littlestown, PA, Frances Tippitt of Loveville, MD, and Carolyn Walker of Gettysburg, PA.  Also surviving are many nieces and nephews.

She was predeceased by a brother, James D. Morningstar.

Funeral services will be held at 11:00 a.m. on Tuesday, October 29, 2013 at the Myers-Durboraw Funeral Home, 136 E. Baltimore St., Taneytown with Chaplain Charline R. Fowler officiating.

Burial will be private.

The family will receive friends from 2-4 & 6-8 p.m. on Monday at the funeral home.

In lieu of flowers, memorial contributions may be made to “Toop’s Troops” c/o:  Community Foundation of Carroll County, 255 Clifton Blvd., Suite 313, Westminster, MD  21157.
